In Virginia, statutory rape is governed by Code of Virginia § 18.2-61. This law makes it a felony to engage in sexual intercourse with a minor who is 13 years old or younger. If the minor is between 13 and 15 years old, the offense is punishable as a Class 4 felony. If the minor is under 13 years old, the offense is punishable as a Class 3 felony.
